Terms & Conditions Policy

This page outlines the rules, guidelines, and legal agreements that govern your use of our services. By accessing or using our platform, you agree to comply with these terms.

1. Definitions

1.1 “We”, “Us”, “Our” means JRS Training & Assessment Ltd.

1.2 “You”, “Your” means the individual or organisation booking or purchasing our training or assessment services.

1.3 “Services” means any training course, qualification, assessment, consultancy or other services provided by JRS Training & Assessment Ltd.

Section A – Short Course Terms and Conditions

(Applies to CITB Site Safety Plus, Health & Safety Awareness, Temporary Works, NPORS, First Aid and all other short courses unless otherwise stated.)

2. Booking Confirmation

2.1 A booking is confirmed once we receive written confirmation by email, an online booking, or a Purchase Order.

2.2 By confirming a booking, you agree to these Terms and Conditions.

3. Prices and Payment

3.1 All prices are exclusive of VAT unless otherwise stated.

3.2 Payment must be made in accordance with the payment terms shown on the invoice unless otherwise agreed in writing.

3.3 We reserve the right to withhold course materials, certification and future bookings where invoices remain unpaid.

4. Delegate Information

4.1 The customer is responsible for providing accurate delegate details before the course begins.

4.2 Any special requirements should be notified at the time of booking. This includes, but is not limited to:

  • Physical disabilities
  • Hearing or visual impairments
  • Learning difficulties (such as dyslexia)
  • Any other reasonable adjustments

4.3 While we will make every reasonable effort to accommodate delegates’ needs, this may not always be possible without sufficient notice.

5. Course Transfers

5.1 Requests to transfer a delegate to another course date must be made in writing.

5.2 Transfers are subject to availability and are at the discretion of JRS Training.

6. Cancellations

6.1 All cancellations must be made in writing.

6.2 Cancellation charges are:

  • More than 5 working days before the course start date: No charge.
  • 5 working days or fewer before the course start date: 100% of the course fee.

6.3 Course fees are charged because instructor time, venues, awarding body registrations, administration and course materials are committed in advance.

6.4 Delegate substitutions may be made at any time before the course begins at no additional charge, provided the replacement delegate meets any course prerequisites.

7. Non-Attendance

7.1 Failure to attend a booked course without prior written cancellation will be treated as a cancellation within 5 working days and the full course fee will remain payable.

8. Cancellation by JRS Training

8.1 We reserve the right to postpone or cancel a course due to circumstances beyond our reasonable control or where delegate numbers are insufficient.

8.2 Where this occurs, customers will be offered either:

  • an alternative course date; or
  • a full refund of course fees already paid.

8.3 Our liability is limited to the course fee only. We are not responsible for travel costs, accommodation, loss of earnings or any other consequential losses.

9. Attendance and Certification

9.1 Delegates must attend the full duration of the course.

9.2 Certification is subject to:

  • Successful completion of the course;
  • Compliance with awarding body requirements; and
  • Full payment of all outstanding fees.

Section B – NVQ Terms and Conditions

10. Booking and Registration

10.1 A contract is formed once we receive written confirmation to proceed with an NVQ programme.

10.2 Candidate registration with the awarding body may take place shortly after booking.

10.3 Awarding body registration fees are non-refundable once registration has been completed.

11. Prices and Payment

11.1 Prices are exclusive of VAT unless otherwise stated.

11.2 Payment terms will be agreed before enrolment.

11.3 Failure to make payment may result in suspension of assessment activity until the account is brought up to date.

11.4 Certificates will not be released until all outstanding balances have been paid.

12. Learner Responsibilities

12.1 Learners are expected to actively participate in their qualification.

12.2 Learners must provide evidence and attend planned assessment activities within agreed timescales.

12.3 Employers should provide reasonable access to the workplace where assessment is required.

13. Duration

13.1 Most NVQs are designed to be completed within approximately six months.

13.2 All qualifications should normally be completed within twelve months unless otherwise agreed.

13.3 Where completion extends beyond twelve months, additional assessor time may be chargeable. Any additional charges will be discussed and agreed before work continues.

14. Cancellation

14.1 Cancellation requests must be made in writing.

14.2 Once awarding body registration has taken place, registration fees cannot be refunded.

14.3 Where assessment work has already been undertaken, JRS Training reserves the right to retain fees or invoice for work completed up to the date of cancellation.

14.4 If a learner leaves employment or no longer wishes to continue, this does not automatically remove the employer’s responsibility for outstanding fees where the employer arranged the booking.

15. Assessment Visits

15.1 Planned assessment visits should only be cancelled where absolutely necessary.

15.2 Where visits are cancelled at short notice, additional assessor costs may be incurred where travel or assessor time has already been committed.

15.3 Any such charges will be discussed with the customer before being applied.

16. Certification

16.1 Certificates will only be claimed once:

  • all assessment criteria have been achieved;
  • internal quality assurance has been completed;
  • awarding body requirements have been met; and
  • all outstanding fees have been paid.

General Terms

17. Data Protection

17.1 We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

17.2 Our Privacy Policy is available on request or via our website.

18. Force Majeure

18.1 We shall not be liable for delays or failure to perform our obligations where such failure results from events beyond our reasonable control.

19. Liability

19.1 Nothing within these Terms excludes liability for death or personal injury caused by negligence or for fraud.

19.2 Subject to clause 19.1, our liability is limited to the value of the services purchased.

19.3 We shall not be liable for indirect or consequential losses, including loss of profit, revenue or business opportunity.

20. Governing Law

20.1 These Terms and Conditions shall be governed by the laws of England and Wales.

20.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
